Welcome to Darshan Delights ("we", "our", "us", "the Company"). These Terms of Service ("Terms") govern your access to and use of the Darshan Delights website and mobile application ("App") (collectively, the "Services"), including browsing products, creating an account, and purchasing products.

By accessing or using our Services, you agree to be bound by these Terms, our Privacy Policy, and our Refund Policy. If you do not agree to these Terms, please do not use our Services.

Acceptance of Terms
1. Agreement
  By accessing our website, downloading our App, creating an account, or making a purchase, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.
2. Eligibility
  You must be at least 18 years old to use our Services. By using our Services, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.
3. Changes to Terms
  We reserve the right to update or modify these Terms at any time. Changes take effect immediately when posted on our website or App. Your continued use of our Services indicates acceptance of the updated Terms. We will notify you of significant changes via email or App notification.
Mobile Application License
1. License Grant
  Subject to your compliance with these Terms, Darshan Delights grants you a limited, non-exclusive, non-transferable, revocable license to:
  - Download and install the App on your personal mobile device
  - Use the App solely for your personal, non-commercial purposes
2. License Restrictions
  You agree NOT to:
  - Copy, modify, distribute, sell, or lease any part of the App
  - Reverse engineer, decompile, or attempt to extract the source code
  - Remove, alter, or obscure any copyright, trademark, or proprietary notices
  - Use the App for any unlawful, fraudulent, or malicious purpose
  - Interfere with or disrupt the App's functionality or security
  - Use automated systems, bots, or scripts to access the App
  - Attempt to gain unauthorized access to our systems or other users' accounts
  - Use the App in any way that violates these Terms
3. App Updates
  We may release updates to the App that include bug fixes, new features, or security improvements. You agree that:
  - We may automatically update the App on your device
  - Some updates may be required to continue using the App
  - Continued use after updates constitutes acceptance of any changes
  - We are not obligated to provide updates or maintain backward compatibility
4. Third-Party Services
  The App may integrate with third-party services (payment processors, mapping services, analytics). Your use of these services is subject to their respective terms and privacy policies.
Account Registration and Security
1. Account Creation
  To access certain features, you must create an account. When creating an account, you agree to:
  - Provide accurate, current, and complete information
  - Update your information to keep it accurate and current
  - Maintain the confidentiality and security of your password
  - Accept responsibility for all activities under your account
  - Notify us immediately of any unauthorized access or security breach
2. Account Credentials
  - You are responsible for all activities conducted through your account
  - Do not share your login credentials with others
  - Use a strong, unique password for your account
  - Log out of your account on shared or public devices
3. Biometric Authentication
  If you enable biometric authentication (Face ID, Touch ID, or Fingerprint):
  - You authorize anyone whose biometrics are registered on your device to access your account
  - You are responsible for managing who has biometric access to your device
  - You can disable biometric login at any time in Profile > Security
  - We do not store your biometric data; it remains on your device
4. Account Suspension and Termination
  We reserve the right to suspend or terminate your account without notice if:
  - You violate these Terms or any other policies
  - We suspect fraudulent, abusive, or illegal activity
  - You fail to pay for orders or engage in payment fraud
  - Your account is used for unauthorized commercial purposes
  - Required by law or government authority
  Upon termination:
  - Your license to use the App is immediately revoked
  - You must cease all use of the App
  - We may delete your account data (subject to legal retention requirements)
  - Pending orders may be cancelled
Push Notifications
1. Consent
  By enabling push notifications, you consent to receive:
  - Order status updates and delivery notifications
  - Account and security alerts
  - Promotional messages, special offers, and discounts
  - Product recommendations and reminders
2. Managing Notifications
  You can manage notification preferences:
  - In the App: Profile > Notification Preferences
  - In device settings: Disable notifications for Darshan Delights
  - Disabling notifications may affect your ability to receive important order updates
Products and Services
1. Product Information
  We strive to provide accurate descriptions, images, and prices. However, we do not guarantee that all content is error-free, complete, or current. Product images are for illustration purposes and may differ slightly from actual products.
2. Availability
  All products and services are subject to availability. We reserve the right to:
  - Limit quantities per customer
  - Discontinue products without prior notice
  - Refuse or cancel orders at our discretion
3. Pricing
  - All prices are displayed in Australian Dollars (AUD)
  - Prices include GST (Goods and Services Tax) where applicable
  - Prices are subject to change without notice
  - We are not liable for pricing errors or typographical mistakes
  - If a pricing error is discovered, we will notify you and offer to cancel the order
Ordering and Payment
1. Order Placement
  By placing an order, you make an offer to purchase the selected products. All orders are subject to our acceptance. We may refuse or cancel orders for any reason, including:
  - Product unavailability
  - Pricing or description errors
  - Suspected fraud or unauthorized activity
  - Failure to meet eligibility requirements
2. Payment Terms
  - Payment must be made in full at the time of ordering
  - We accept payment methods as listed in the App (credit/debit cards, Apple Pay, Google Pay)
  - All transactions are processed securely by Stripe
  - You agree to provide accurate and complete payment information
  - We reserve the right to verify payment information before processing orders
3. Payment Security
  - Payment processing is handled by Stripe, a PCI-DSS compliant payment processor
  - We do not store your full credit card number on our servers
  - By making a purchase, you agree to Stripe's terms of service
4. Order Confirmation
  - You will receive an email and/or push notification confirming your order
  - Order confirmation does not constitute acceptance until the order is dispatched
  - We reserve the right to cancel orders after confirmation if issues arise
Shipping and Delivery
1. Dispatch Times
  We aim to dispatch orders within 1-2 business days after receiving payment. Dispatch times may vary during peak periods or due to circumstances beyond our control.
2. Delivery Times
  Delivery times depend on your location and selected shipping method:
  - Sydney Metro: 1-3 business days
  - Regional NSW: 3-5 business days
  - Other Australian states: 3-7 business days
  These are estimates only and not guaranteed delivery dates.
3. Delivery Responsibility
  - We are not responsible for delays caused by shipping carriers, weather, or other circumstances beyond our control
  - Risk of loss or damage passes to you upon delivery to your specified address
  - You are responsible for providing accurate delivery information
  - Failed deliveries due to incorrect addresses may incur re-delivery charges
4. Shipping Costs
  - Delivery fees are calculated at checkout based on order weight and destination
  - Free shipping is available on orders over $100 within Sydney Metro
  - Shipping costs are non-refundable unless required by Australian Consumer Law
5. Local Pickup
  - Local pickup is available from our store at 8 Lethbridge Road, Austral, NSW 2179
  - Pickup hours: Mon-Fri 5PM-8PM, Sat-Sun 9AM-5PM
  - Orders must be collected within 7 days of notification
  - Valid ID may be required for pickup
Returns, Refunds, and Consumer Guarantees
1. Australian Consumer Law
  Our products come with guarantees that cannot be excluded under Australian Consumer Law (ACL). You are entitled to:
  - A replacement or refund for a major failure
  - Compensation for any other reasonably foreseeable loss or damage
2. Refund Policy
  Our full Refund Policy is available on our website and in the App. Key points:
  - Refund requests should be made within 10 days of purchase or delivery
  - Products must be returned in original condition unless faulty
  - Proof of purchase is required
  - We do not offer refunds for change of mind (unless required by ACL)
  - Perishable goods cannot be returned unless faulty
3. Refund Processing
  - Refunds are processed within 5-10 business days of receiving returned items
  - Refunds are issued to the original payment method
  - Shipping costs are non-refundable unless the return is due to our error

Intellectual Property
1. Ownership
  All content on our website and App, including but not limited to:
  - Text, graphics, logos, images, and photographs
  - Software, code, and functionality
  - Product descriptions and pricing
  - User interface design and layout
  is the property of Darshan Delights or its licensors and is protected by Australian and international copyright, trademark, and other intellectual property laws.
2. Limited Use
  You may not use, reproduce, modify, distribute, display, or create derivative works from any content without our prior written consent.
3. Trademarks
  "Darshan Delights" and our logo are trademarks of Darshan Delights. You may not use our trademarks without prior written permission.
User Content
1. Reviews and Feedback
  By submitting reviews, feedback, or other content ("User Content"), you:
  - Grant us a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, publish, and display such content across our website, App, and marketing materials
  - Confirm that the content is your original work, accurate and does not violate any third-party rights
  - Agree not to submit content that is defamatory, obscene, offensive, discriminatory, misleading, or illegal
  - Acknowledge that your review may be displayed publicly alongside your first name or username
  - Accept that reviews may be associated with verified purchase badges where applicable
2. Prohibited Content
  You agree NOT to submit content that:
  - Contains false, misleading or fraudulent information
  - Infringes on any copyright, trademark, or intellectual property rights
  - Contains personal information of others without their consent
  - Includes spam, advertising or promotional material
  - Contains viruses, malware or harmful code
  - Violates any applicable laws or regulations
  - Is abusive, harassing, threatening or discriminatory
3. Content Moderation
  We actively moderate user-generated content to maintain a safe and helpful community. We reserve the right to:
  - Review all submitted content before or after publication
  - Remove, edit o refuse to publish any content at out sole discretion
  - Suspend or terminate accounts that repeatedly violate content guidelines
  - Report illegal content to appropriate authorities
  - Take any action we deem necessary to protect our users and platform
Privacy
Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your personal information. By using our Services, you consent to our data practices as described in the Privacy Policy.
Limitation of Liability

  To the fullest extent permitted by law:

- Your breach of these Terms

- Any content you submit through our Services
Dispute Resolution
1. Informal Resolution
  Before initiating any legal proceedings, you agree to attempt to resolve disputes informally by contacting us at contact@darshandelights.com.au. We will attempt to resolve the dispute within 30 days.
2. Mediation
  If informal resolution fails, either party may initiate mediation through a mutually agreed mediator. Costs shall be shared equally.
3. Legal Proceedings
  If mediation fails, disputes may be resolved through the courts of Australia.
Third-Party Links
Our website and App may contain links to third-party websites or services. These links are provided for your convenience and do not imply endorsement. We have no control over, and are not responsible for, the content, privacy policies, or practices of any third-party sites. Access to these links is at your own risk.
Termination
1. By You
  You may terminate your account at any time by:
  - Deleting your account in the App (Profile > Delete Account)
  - Contacting us at contact@darshandelights.com.au
2. By Us
  We may terminate or suspend your access without notice for violations of these Terms or for any other reason at our discretion.
3. Effect of Termination
  Upon termination:
  - All rights and licenses granted to you cease immediately
  - You must stop using our Services and delete the App
  - Provisions that by their nature should survive termination will survive
General Provisions
1. Entire Agreement
  These Terms, along with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Darshan Delights regarding your use of our Services.
2. Severability
  If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
3. Waiver
  Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
4. Assignment
  You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
5. Governing Law
  These Terms are governed by the laws of the Commonwealth of Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
